Just got this in my email. Its from a local repair shop. To Whom It May Concern: On April 9, 2021, (xx Diesel shop name deleted xx), entered into a settlement with the United States Environmental Protection Agency (U.S. EPA) to resolve alleged violations of Section 203(a)(30(A) and 203(a)(3)(B) of the Clean Air Act, related to the removal and/or rendering inoperative of emission control devices or elements of design and selling, offering to sell, and/or installing defeat devices for use with heavy-duty diesel engines. By signing a consent agreement with U.S. EPA, [xx diesel repair shop xx] has certified that it will comply with Section 203(a)(3) of the CAA, which makes it unlawful for: “(A) any person to remove or render inoperative any device or element of design installed on or in a motor vehicle or motor vehicle engine in compliance with regulations under [Title II of the CAA] prior to its sale and delivery to the ultimate purchasers, or for any person knowingly to remove or render inoperative any such device or element of design after such sale and delivery to the ultimate purchaser; or (B) for any person to manufacture or sell, or offer to sell, or install, any part or component intended for use with, or as part of, any motor vehicle or motor vehicle engine, where a principal effect of the part or component is to bypass, defeat, or render inoperative any device or element of design installed on or in a motor vehicle engine in compliance with regulations under [Title II of the CAA], and where the person knows or should know that such part or component is being offered for sale or installed for such use or put to such use.” ( xx diesel shop name xx) will pay a penalty and comply with the consent agreement to ensure ongoing compliance with the Clean Air Act. Probably forced to sign in order to keep liscencing. Just opens the door for after hours jobs, or come on around back.
I don't know, there is a shop we have used to "fix" the emissions systems our diesel pickups when they inevitably need it. They wouldn't talk about it on the phone, just bring it in, tell them to fix it and pay them cash when done. The last one we took in he said no more, he may be headed to jail but wasn't sure yet. He didn't know how they found out but the SWAT team showed up with the cops when they arrested him. He didn't know if his business would survive it. He did fix the truck but with all factory parts this time. The days of being like Hillary (delete delete delete!) are about gone unless you do it yourself I think.
And once you do that, no one else can touch it because they will never be quite sure what the last guy did and if it will react badly with the current repair of whatever. They got us coming and going.
That sucks you guys got it so bad about deletes. We are still all good up here.
We have a lot of DPF stuff..... ummm modified???? It's only a matter of time. They really started cracking down on motor vehicle inspections here, and then they went to a 2 year safety sticker. A lot of people don't even look at their vehicle until it gets a safety. People were complaining about the cost, so instead of paying $25 a year for a sticker, now you pay $55 every 2. Gotta love that logic. After all these years of DOT checks for trucks, it's hard to believe I can still run up and down the roads with loader or a grader with no brakes.
Ontario has annual safety inspections for heavy trucks, and emissions tests every other year if you passed with good enough numbers. They announced last year they would be tying the e-test to the annual safety. Any evidence of a delete, and no more safety for you, which means no truck on the road...and they've put all of this at the feet of mechanics who will lose their licence if there's any funny business.
A local performance shop has agreed to restore as many trucks as he can, voluntarily. That was one of the more interesting deals that was made. When I started reading your letter I thought it would be similar, but no. My 2007 5.9 I rebuilt with all stock parts and reman stock injectors. It was a year that happened to be without EGR and before DPF, so I will likely wear it out a couple of times
A while back i got a crafty letter from Ford , some kind of recall on the emissions system on my 2015 F350 . I think they are on a fishing expedition to see who has deleted . Maybe they noticed a sharp drop in my DEF purchases. But who knows i could be buying bulk DEF with bitcoins .
When the EPA realized they were letting good money get away (aka fines) then they got serious about enforcement. Things are still pretty lax here as far as county emissions, they look around the engine like they know what they are doing and use the ol mirror on wheels, then get on to the test.
We had a transmission software update on the 2 550s, and an exhaust gas temp sensor on the diesel. But they gave us the new harness to install.
